I earlier reported on a California Supreme Court decision limiting the application of a broad exclusion of "pollution" liability in a case involving ordinary legnlgince that led to the release of a toxic chemical (in that case, an insecticide).
Of related interest, the D.C.-based Insurance Defense Blog is reporting on a similar decision from the District of Columbia Court of Appeals, declining to apply the pollution exclusion to a case involving residential carbon monoxide poisoning.
