I was injuried August 4, 2002. Filed a workers compensation claim September 1, 2002. Filed adversary complaint July 1, 2004. Do I have a personal injury claim?


In a probable medical malpractice situation, are there any avenues to extend the one-year statute of limitation? The insurance company says it's one year from date of injury or 3 years from date of treatment. However, I've found a site that adds the phrase "whichever comes first." Thus, the one year deadline is only 6 weeks away, and I need to know whether or not this can be extended for the purpose of allowing the insurance company to conduct more investigation. Thx.
